NFPA Webinar: Flexible PI Settlements and Qualified Settlement Funds Presented by: Jeremy Babener & Rachel McCrocklin Plaintiffs use Qualified Settlement Funds (QSFs) to ensure defendants’ payment without further defense involvement. It releases defendants from liability upon payment while preserving plaintiff options to make pre-settlement decisions. Deciding how to allocate proceeds, resolve liens, and address tax treatment, can often take considerable time. QSFs allow plaintiffs to address such issues while avoiding any risk of defendants “walking back” a settlement offer. Defendants benefit too by obtaining an immediate release and tax deduction. This presentation will identify when and how to use QSFs for the benefit of plaintiffs, defendants, and lawyers on both sides.
