NFPA Webinar: Flexible PI Settlements and Qualified Settlement Funds

Plaintiffs use Qualified Settlement Funds (QSFs) to ensure defendants’ payment without further defense involvement. It releases defendants from liability upon payment while preserving plaintiff options to make pre-settlement decisions. Deciding how to allocate proceeds, resolve liens, and address tax treatment, can often take considerable time. QSFs allow plaintiffs to address such issues while avoiding any risk of defendants “walking back” a settlement offer. Defendants benefit too by obtaining an immediate release and tax deduction. This presentation will identify when and how to use QSFs for the benefit of plaintiffs, defendants, and lawyers on both sides. And how to make sure plaintiffs get those benefits by ensuring regulatory compliance.

 

Meet Your Presenter:

Jeremy Babener, is a tax lawyer and specializes in issues and strategies at lawsuit settlement. He writes for Forbes and serves on the legal committees for the three national settlement planning associations and the ABA Plaintiffs' Practice Committee in the Tort Trial & Insurance Practice Section. 

 

Rachel McCrocklin is the Chief Trust Officer for Eastern Point Trust Company, the most prolific administrator of Qualified Settlement Funds. Rachel writes on settlement and trust issues for the American Bar Association, presents for the Federal Bar Association and Practicing Law Institute, and is quoted as an expert in the industry in various publications.
