About the Presenter
Mariana Fradman is a Senior Specialist with the Real Estate and Investments Group in the Office of the General Counsel at New York Life Insurance Company (“NYLIC”) and has over 20 years of paralegal experience in real estate practice, concentrating in the areas of transactional real estate law, representing institutional, commercial, and developer clientele in connection with financing, acquisition, development, leasing, and disposition of various property types, including office, retail, industrial, and multi-family residential as well as condo, co-ops, and single-family properties. Additionally, she specializes in corporate law, distressed debt and bankruptcy proceedings.

In addition to her full-time job at NYLIC, Ms. Fradman is an Adjunct Professor at Long Island University, Brooklyn Campus, teaching ethics, contracts, business and real estate law courses at the Paralegal Certificate Program.

Ms. Fradman is Vice President, CLE Chairperson and Mentor Program Chairperson at New York City Paralegal Association, Inc. (“NYCPA”). Mariana was re-appointed as an Ethics and Professional Responsibility Coordinator for the National Federation of Paralegal Associations (NFPA) in January 2020
and is a member of NFPA's Ad Hoc Committee on Rogue Paralegals. As a seasoned professional, Ms. Fradman has presented at various continuing legal education seminars in person and on-line, including, but not limited to Long Island University, Brooklyn Campus, New York Career Institute, Lorman Educational Services, Paralegal Knowledge Institute, Clear Law Institute and at numerous CLE seminars presented by NYCPA. She was awarded the " Distinguished Faculty " Badge by Lorman Educational Services in February 2014. Mariana’s articles were published on The Paralegal Society Blog , The Paralegal Resource and the National Paralegal Reporter.

Ms. Fradman received her B.S. in Legal Studies from NYC Technical College (CUNY) and an MBA from the University of Phoenix. She received B.S. and M.S. in Engineering and Technology from the National Polytechnic University, Odesa, Ukraine. Ms. Fradman is a member of Phi Theta Kappa and Tau Phi Sigma National Honors Societies and was listed on the Dean's List of Scholars (1994-1998). While studying toward her degree in Legal Studies, Mariana volunteered both as a counselor at NYPIRG’s Small Claims Court Group and as a legal assistant in the Brooklyn Bar Association’s divorce and elder law clinics. She received The Brooklyn Bar Association Volunteer Lawyers Project’s Certificate of Appreciation , Alumni Achievement Award and West Legal Studies Award for Outstanding Scholastic Achievement (1996-1998).

Ms. Fradman and her family immigrated to the United States in January 1992. Currently, Mariana lives in Brooklyn with her husband. She has three children and five grandchildren.

The duty of (identification and) preservation is a foundational concept in our legal system that grows out of the common law concept of "spoliation," which is more than 200 years old. As we have seen in numerous contexts, however, ESI spoliation remains a frequent issue– particularly in the gray area where new devices, applications, or services are transitioning from niche adoption to mainstream use. Hence the importance of these phases in an eDiscovery effort: almost every other type of failure can be fixed with adequate time and money, but once unique, relevant ESI is gone, it's gone.
